My listing was reported. What should I do?

Check out how to respond to an intellectual property report and what to expect in each step of the process.

As part of the Brand Protection Program, rights owners or their representatives are able to report alleged intellectual property infringements on the website listings.

Check here how the reporting process works so you can manage your listings efficiently. This way, together we can offer the best shopping experience and, consequently, you gain the buyers' trust.

 

2. The rights owner submits the report 

We will notify you that your listing was paused and it will be shown as "Inactive due to a report" in the listings list.

2. Submit your response 

Upon receiving a report, you will have the chance to reply to the rights owner within 4 calendar days.

On the Help page you will find tips on how to respond to a notice of claimed infringement. Note that if you do not respond within the deadline, your listing will be removed.

 

3. The rights owner checks your response 

After you appeal the notice, the complainant will have another 4 calendar days to review your response and decide whether to confirm or withdraw their report.

  • If the report is withdrawn, the listing will be automatically reinstated. If it is confirmed, the listing will be removed permanently.
  • If the complainant does not respond within the deadline, the listing will be reinstated.

 

What should you do if you disagree with the decision? 

If you disagree with the decision, you can contact the complainant by the email we provide you when the reporting process finishes.

Mercado Libre does not interfere in the complainant's decision.

If you reach an agreement with the right owner that reported your listings the complainant must contact Mercado Libre requesting us to reinstate your listing.

If you believe that the complainant has abused the BPP, please gather the evidence and contact us. We will help you by analyzing your case and taking the necessary measures.

 

Reporting history 

If your listing is reported more than once, you can check the details in the "Reports history" section. Thus, you will be able to check the responses you received and the complainants' decisions.

You can access the reporting history from the actions menu when you select the 3-dotted menu on the line of the reported listing.

Have in mind that through this feature you can learn more about intellectual property rights and how to avoid infringing third parties rights when creating a listing.

Remember that these reports may result in suspension of your account, as well as a permanent restriction to sell.
