What should I do if my listing infringes intellectual property rights?

Check below the different types of infringements. Please review your listings and make sure not to infringe the intellectual property rights or any law in force.

Counterfeit product

It is prohibited to list counterfeit products, imitations, or copies because they are products not manufactured or authorized by their trademark owners. For example, a smartwatch that reports to be Xiaomi branded when in fact it is not, or earbuds that copy the shape of AirPods, when they are not actually from Apple.

To avoid this type of infringement, please:
Always list original products.

 

Copyright infringement

Copyrights protect original intellectual works, such as movies, music, photographs, books, courses, video games, characters, and software. A copyright infringement could be: offering license copies of software, such as Adobe or Microsoft 365, or selling an original console with preloaded video games.

In order to avoid this type of infringement, please::
Do not offer unauthorized copies of books (such as in PDF format), manuals, study guides, courses, software, video games, photos, music, or movies; or derivative works without permission of the right's holder, for example, translations and adaptations.
Offer recordings of music, programs, movies, shows, performances, sporting events, and/or series only on the original media marketed by the respective producers.

 

Patents, utility models rights infringement

Patents protect new, non-obvious inventions that apply to an industry. A patent or utility model infringement may be to offer products that provide the same technical solution as a patent or utility model.

In order to avoid this type of infringement, please:
Avoid offering products that are replicas or offer the same technical solution.
Offer products only if you can certify that you are the patent owner or that you are authorized by the owner to commercially explore the invention.
