Shape mark

Protects the shape or presentation of a product in its three dimensions (height, width and depth) and its packaging or wrappers, if they differentiate it from other brands on the market. 

Some of the most common examples of infringements for counterfeit goods involving shape marks are: 

    • Earbuds with a design that copies the AirPod, without them actually being from Apple
    • Smartwatches that copy Xiaomi watches
    • Fragrances that copy the bottle design of other perfume brands

To avoid this type of infringement, we recommend that you sell products that do not copy the specific shape of products associated with another brand. Otherwise, the product you offer may be removed from the listing list
